Description

In this section, you will learn how workations or temporary remote work from abroad affect applicable labor law and the jurisdiction of authorities and courts.

Working abroad affects key areas such as working hours and rest periods, public holidays, protection against dismissal, and health and safety standards. Failure to clarify these issues can lead to claims against the employer or unintentional violations of local regulations.

Contractual agreements cannot exclude these requirements. Swiss law can be agreed as the contractual basis, but the mandatory provisions of the host country also apply. This often results in parallel obligations that companies need to be aware of and take into account in their HR processes.

In this session, you will receive specific recommendations on how companies can legally comply with these requirements in a remote work or workation policy and set them out in a contract.
